As we have reported, Commissioner of Police Chester Williams has ordered a criminal and administrative investigation. The three officers were placed on immediate interdiction pending the investigation. ComPol Williams discussed the case today.

“The police department considered the actions who were working the cell block as well as executive duty officer on duty at the time to be an act of gross negligent in that they failed to ensure that these two prisoners who both had some mental disability were kept in the same cell detained. We have our protocols that covers the cell block area and from what the investigation is showing so far there was a clear breach of our cell block protocol and so the officers who were on duty at particular time have since been placed on disciplinary charges and have been interdicted from duty on half pay, the police officers know or ought to have known that his condition was such that he had not been kept with any other person in a cell block and so to have placed another person with him whether the person is of similar character meaning having some mental disability makes it even worst to put two of them in the same cell and so we have to make sure that corrective measures are taken to ensure that this does not reoccur.”

ComPol Williams will be appointing an independent adjudicator to hear and decide on the fate of the officers.

“They have been arraigned and I have directed that one, will be getting an independent adjudicator meaning that that matter will not be adjudicated by any sitting senior police office it will be adjudicated by somebody outside of the department because under the amendment to the police act it do give the Commissioner of Police the authority to appoint anybody who he believes it fits and capable who can adjudicate matters relating to police officers so to ensure there is no saying that oh the commissioner put the senior office to do the case and give instructions am saying to ensure that there is transparency and to be fair I have appointed a former senior police officer to adjudicate the matter and my directive is that we must ensure that the principle of natural justice is followed to tee because we want that whatever end result of the tribunal is that if those persons were to be convicted and appeal the conviction will be upheld, we don’t want to rush something and when time come we get a conviction and they appeal and then the Advisory Council informs us that we have not followed xyz over turn the conviction then process starts all over again so we want to ensure that we do this right so to answer your question the tribunal will be done within a reasonable time and I do not expect it to last no longer than four months, I believe that four months is sufficient for them to be able to prepare the defense and present their case before a tribunal.”
